What are the Penalties for Violent Crimes?
As of 2020 Colorado has become the 22nd state to repeal the death penalty through Senate Bill 20-100, however, violent crimes are still among the most harshly punished crimes. Misdemeanors include class 1, class 2, class 3, & uncategorized which are penalized significantly less than felonies. Misdemeanors are typically penalized by no more than 1.5 years in jail or $5k in fines.
However, if you are being charged with a serious violent crime it is more likely that you are facing a felony. Colorado does operate under mandatory sentencing guidelines & the following are the sentencing guidelines for felony crimes:
- Class 1 Felonies - Sentencing Includes Life in Prison
- Class 2 Felonies - Mandatory 8 years, up to 24 years, & up to $1,000,000 in fines
- Class 3 Felonies - Mandatory 4 years, up to 12, & up to $750k in fines
- Class 4 Felonies - Mandatory 2 years, up to 6 years, & up to $500k in fines
- Class 5 Felonies - Up to 3 years & up to $750 in fines
- Class 6 Felonies - Up to 2 years & up to $100k in fines
- Uncategorized Felonies - Up to 5 Years
Additionally, it is likely that a mandatory 5 year enhancements will be added to your sentencing if a dangerous weapon was used during the violent crime you have been convicted of.
